Wiggle Australia fined by ACCC for misleading customers

Postby AUbicycles » Sun Dec 23, 2018 10:19 pm

Reported by Bicycling Australia Magazine:
Online retail behemoth Wiggle has been fined $12,600 by the Australian Competition and Consumer Commission after admitting its customer service staff "likely misled" Aussie customers about their consumer rights.
“Under the Australian Consumer Law, consumers are entitled to a repair, replacement or refund when there has been a major problem with the product. This law applies to all businesses that sell products to consumers in Australia, including overseas based businesses,” ACCC Deputy Chair Delia Rickard said in a statement
Bicycling Australia

This is a confirmation that any overseas businesses who retail to Australia customers technically need to satisfy Australian consumer law. The ability to perfectly enforce this may be difficult.

In this case, Wiggle have a local office and this very easily make them more approachable and the brand also have a strong interest in complying.

Presently experiencing ZERO customer service from Wiggle over a $550 bushwalking tent lost by Auspost who have formally admitted liability.
Emails to Wiggle seeking refund/resupply completely ignored to date. A PayPal claim is now in process.
Beware of Wiggle!

Wow, a $12,600 fine, that should get their attention . . . for about 5 seconds.

Maybe if companies faced real penalties they might change their behaviour.
